Abstract

The article deals with the paradigm change in indigenous politics and points out the need to produce a new look at this topic, considering the history, culture and struggle processes of the Guarani People. After the Federal Constitution of 1988 and Convention n. 169 of the International Labor Organization (ILO Convention n. 169) it is understood that the development of interdisciplinary studies is necessary to contribute to the processes of demarcation and recognition of indigenous territories by the Brazilian State. Throughout deductive methodology, and bibliographic and documentary review, it presents, firstly, the historicity of the category “indigenous land”. Afterwards, it addresses indigenous demands in the context of ethnic identities based on legal pluralism. Then, it deals with Guarani territoriality, its history and struggle processes aiming to contribute with a contemporary vision of indigenous territorial rights. In the end, it verifies that only based on a theoretical-critical perspective, interdisciplinary contributions and with indigenous protagonism is it possible to advance territorial rights in accordance with current regulations.

Mestre em Direitos Humanos, Interculturalidade e Desenvolvimento pela Universidade Pablo de Olavide de Sevilha - Espanha (2010). Graduada em Direito pela Universidade de São Paulo (1998). Professora Colaboradora da Universidade Estadual de Maringá atuando no Departamento de Direito Público (DDP/UEM) desde 2019. Pesquisadora do Observatório de Justiça Ecológica (OJE/UFSC).
