FROM WOLKMER TO LUHMANN AN OBSERVATION OF LEGAL PLURALISM FROM THE PERSPECTIVE OF SOCIAL SYSTEMS THEORY

Abstract
The primary objective of this article is to examine Wolkmer's critical theory of legal pluralism through the observational lens of Luhmann's social systems theory. Consequently, the main question posed by the article is: how is legal pluralism observed through the lens of social systems theory? To address this question, the article is divided into three parts, each with a specific objective: a brief introduction to the theory of legal pluralism; an explanation of some assumptions of social systems theory; and, finally, the observation of legal pluralism within social systems theory, which is the main objective of the article. Legal pluralism will be examined within two systemic theories: Teubner's polycontexturality and Neves' transconstitutionalism. Both theories are used to strengthen the central thesis of the paper: legal pluralism as communication. The method employed is a bibliographic review of the two main theoretical references: Wolkmer and Luhmann. Based on this, a theoretical construction of interweaving between both theories will be undertaken, enabling the translation of legal pluralism into social systems theory.
