Abstract
The objective of this article is to establish a connection between emotional abandonment and the theory of loss of a chance, this relationship will be explored in the most diverse areas of family law and civil law.
Both theories deal with responsibility for repairing damages. On the one hand, emotional abandonment portrays the negligence or omission of parents (one or both) in providing the care, attention, affection and emotional support necessary for the healthy development of the child. On the other hand, the theory of loss of a chance applies in cases where the conduct of an agent deprives another person of the opportunity to obtain a benefit or avoid a loss.
It is demonstrated that parental negligence can be related to the loss of a chance, since it deprives the child of essential opportunities for their development and well-being, causing property losses when these individual reaches adulthood.
When approaching the theme of emotional abandonment and its implications for family law, the argumentative deductive method and bibliographic analysis prove to be essential tools to scientifically substantiate the study.
