Abstract

The research addresses the convergence between competition and digital influence in the field of Trade Dress, highlighting its growing importance in the current commercial scenario. Its main objective is to analyze the legal challenges in protecting Trade Dress in digital environments. This requires an understanding of the evolution of the concept of Trade Dress, the identification of legal challenges in the face of the digital audience and the exploration of legal solutions to protect Trade Dress in this context. The methodology employed encompasses jurisprudential analysis, case studies and a literature review, allowing for the identification of the challenges faced by the legal system when dealing with the protection of Trade Dress in digital environments. This approach aims to provide relevant insights to understand and address the legal dilemmas resulting from the intersection between commercial competition and digital influence. Thus, it seeks to offer valuable contributions to legal practice and policy development in this field, responding to the emerging challenges faced by Trade Dress protection in the digital age.
