INTELIGÊNCIA ARTIFICIAL E DIREITO: UM ESTUDO SOBRE OS IMPACTOS NAS DIMENSÕES DOS DIREITOS HUMANOS FUNDAMENTAIS

Abstract

Artificial Intelligence is developing with the capability to serve different purposes, and Law is one of the areas most impacted by this technology. The confluence of artificial intelligence and Law occurs through the implementation of legal mechanisms or through impacts on society that resonate in the legal field. The development of AI and its application in Law resonates with the first, second, third, and other dimensions of fundamental human rights. Therefore, this work is justified by the disruptive role that technology plays in contemporary society and in the legal field and the vast area of study to be explored by legal practitioners. From this relationship arises the following issue: how can artificial intelligence applied to Law impact fundamental human rights and bring new reinterpretations to these rights? The general objective is to analyze the impact of artificial intelligence on fundamental human rights. The methodology used was qualitative research of an exploratory nature, with bibliographic and documentary research techniques. Regarding the method of approach, the hypothetical-deductive method was used. It is concluded that AI has the power to significantly impact existing rights, both in economic, political, and social aspects, but for now, they do not constitute an autonomous dimension of fundamental human rights.
