NEGOCIAÇÃO COLETIVA E APERFEIÇOAMENTO DE POLÍTICAS PÚBLICAS PARA COMBATE AO TRABALHO ANÁLOGO À CONDIÇÃO DE ESCRAVO DE PRETOS E PARDOS NO BRASIL

Abstract

The present article aims to present, through a deductive approach and bibliographic analysis, the importance on using bargaining collective agreements and the improvement of public policies as a legal instrument headed to the discouragement of the labor in analogous conditions to slavery of blacks and brown-skinned people on the rural field in Brazil. The research problem to be confronted is to understand in which extent the democratic primates of the Brazilian Federal Constitution of 1988 could be affected by the exiguity of legal provisions on the bargaining collective agreements in the brazilian rural environment from 2023 in order to restrain the labor in analogous conditions to slavery, as the necessity of improvement of public policies targeted to the same object. It is underpinned that, not only the high incidence of flagrant evidences of labor in analogous conditions to slavery all over the national territory, but also the fact that black and brown-skinned people represent the majority of the rescued workers, demands more effective legal instruments to the combat of this kind of work. In the end, it was possible to confirm that bargaining collective agreements on the brazilian rural field, as the public policies reached so far has not been sufficient to restrain the occurrence of labor in analogous conditions to slavery, consequently, affecting the democratic pilars stablished by the Federal Constitution of 1988.
