Abstract

"The" man of value "is, in the Nicomachean Ethics, a kind of phenomenological description of the moral subject. Considering the magistrate's figure as the one aimed at the achievement of justice and therefore the realization of the moral subject, it is considered that a critical perspective of the Code of Ethics of the National Magistrates can not do without reference to the work of Aristotle. Aristotle's ethics based on what we might today call an anthropology, or a psychology of a philosophical nature, that not only clarifies the that would be the man in its essence, but also how to present their faculties. It is from this detailed study of human potential that Aristotle structure its ethics. These ideas appear here, therefore, is the foundation of his moral theory, is under a phenomenological, so that if evidence of the practical character and not just theoretical in his ethics proposal. Finally, we show the results of this approach in comparison with the parameters of contemporary legislation, which, although they are more utilitarian than Humanists do not leave anyway to have their base on a notion of justice that is still tax the doctrine of the Greek philosopher."
