THE PROTAGONISM OF THE NON-GOVERNEMNTAL ORGANIZATIONS IN STRATEGIC LITIGATION A STUDY OF BRAZIL’S CONDEMNATIONS BY THE INTER-AMERICAN COURT OF HUMAN RIGHTS (2006-2023)

Abstract

This article aims to identify and systematize the strategic litigation in human rights in the Inter-American System of Human Rights. It answers the question about who they are and how often did act the petitioners that starred strategic litigation in Brazil’s condemnations by the Inter-American Court of Human Rights (2006-2023)? The methodological path used in data collection involves documentary research, a qualitative approach and, as a data interpretation technique, Content Analysis. The results of the 13 sentencing reports analyzed demonstrate that Non-Governmental Organizations signed all the petitions that led to Brazilian condemnations by the Inter-American Court; that the petitioning Non-Governmental Organizations generally act together; that there is a recurrence of petitioning Non-Governmental Organizations and the majority are Brazilian; It was noted that there was a lack of action by national state institutions, within the Brazilian justice system, in the regional system for the protection of human rights, with limited participation as Amicus Curiae, in some cases. It was concluded that these actors play a central role in strategic human rights litigation, in the regional system, and promote important reparation for human rights violations that occur in Brazil.
