THE EXISTENTIAL MINIMUM AND THE RESERVE OF THE POSSIBLE An analysis of the decisions of the public law panels of the TJPA, in the year 2023.

Abstract
ABSTRACT: The research is justified by the need to expand the guarantee of the social right to health as essential for the entire population. The institutes of the Reserve of the Possible and the Existential Minimum are at the forefront of the clash over health guarantees, on the stage of which the TJPA is called upon to analyze claims of this nature. The aim of this investigation is to clarify the option of the TJPA in judging health claims in relation to the institutes. The objectives are to analyze the development of tensions between sovereignty and constitution in the formation of national states and bourgeois revolutions, with the development of the constitutionality bloc of human rights and the social right to health; to establish the concepts and definitions of the existential minimum and the reserve of the possible, with their applications to the right to health and how the TJPA has judged when the clash between the reserve of the institutes are put on the table. The research is predominantly theoretical, with a qualitative approach. Its nature is basic, with hypothetical-deductive logic analysis. The third section is empirical, analyzing judgments. In terms of its objectives, it was exploratory, descriptive and explanatory. As for the procedure, a documentary bibliographical study was carried out, due to the need to analyze the legal foundations of doctrine and legislation, with access to the judgments of the TJPA. The hypothesis that the TJPA judges more favorably to the existential minimum was confirmed.
