THE ROLE OF LAW IN THE PLANNING AND CONTROL OF PUBLIC POLICIES: reflections in connection with the “New Institutionalism”

Abstract

This article aims to adequately introduce legal reflection into the larger invironment of thinking about public policies, and to bring this into the science of law. This task resided in the choice of a theoretical framework  that directly articulated the category of formal rules with the other variables involved in the so-called “public policy production cycle”. The complex web of relations between the State and public policies, dealt with primarily in political science but also in many other departments of applied social sciences and humanities, as incredible as it may seem, is still largely ignored by law – both in the sense of not receiving due attention, and in the sense of not being little or poorly known conception was used, a current of policy study within the scope of political science that assumed a dominant position in literature from the 1980s onwards, precisely because of the importance it gives to the State and its institutions. Thus, this article used a deductive method with a bibliographic and documentary research procedure.
