EUTHANASIA AND BIOETHICS A PARALLEL BETWEEN BRAZILIAN AND DUTCH LEGISLATION

Abstract
The article presents research results on Euthanasia, in the context of Bioethics and its ethical-legal-normative discipline, in a comparative study between legal regulation in Brazil and the Netherlands. To survey and analyze legislation on Euthanasia, we used the federal legislation repository available at http://www.planalto.gov.br, in the brazilian case and https://www.government.nl/topics/euthanasia/euthanasia-assisted-suicide-and-non-resuscitation-on-request, in the case of the Netherlands. It was found that, at the legal-normative level, there is a tension between the constitutional principles of the inviolability of the right to life, on the one hand, and, on the other, the dignity of the human person, which both help to form the architecture of legal assets fundamental and inform the entire complex national and Dutch normative system. The patient-health professionals relationship abandons the traditional paternalism that has always guided this relationship, for an option that provides greater symmetry in decisions involving treatment and even the eventual interruption of life. It was concluded that the regulation of the matter demonstrates that in the Netherlands, legal discipline aims to guarantee the patient's free expression and State control to ensure that the legal requirements for the practice of euthanasia are met by the medical professionals involved in the procedure.
