SURROGACY IN BRAZIL AND THE USA: AN ANALYSIS OF COMPARATIVE LAW

Abstract
How much does a surrogate mother cost? The answer to this question goes deeper than just a quantitative nuance. In fact, the analysis must take into account the qualitative and social value involved, especially for the surrogate mother, who in cases of clandestine surrogacy is the one who will suffer the worst consequences. Currently, in Brazil, the issue is only regulated by resolutions of the Federal Council of Medicine. Therefore, the present study aimed to assess whether surrogacy in Brazil really needs to be regulated by law. To this end, the methodology used was a bibliographic review of the subject and comparative law between Brazil and the United States, where there is regulation in some states. Thus, the various aspects of the nomenclature, concept and context of surrogacy, the pros and cons of regulation, and the governing legislation in Brazil and the United States on the subject were analyzed. In the end, it was possible to conclude that regulation of the issue is necessary, at least at the infra-constitutional level, but for the moment, without drastic changes to the system already adopted by the Federal Council of Medicine.
