NON-PROSECUTION AGREEMENT IN THE ELECTORAL SPHERE: an analysis of its potential under the normative perspective of the National Council of the Public Prosecutor's Office

Abstract

This article analyzes the applicability of the Non-Prosecution Civil Agreement (ANPC) in the electoral sphere, emphasizing the normative role of the National Council of the Public Prosecution Service (CNMP). It argues that despite the ANPC lacking comprehensive regulation, current norms are sufficient for its application in Electoral Justice. The text is structured into three main sections. The first section examines the CNMP's normative role in promoting consensuality, identifying key normative acts, regulatory gaps, and ways to address them. The second section focuses on the regulation of the ANPC within the Brazilian legal system. The third section advocates for the intercommunicability between norms derived from the regulatory system of administrative improbity and electoral norms. Methodologically, the article adopts a hypothetical-deductive approach, utilizing bibliographic exploration and analysis of normative instruments. It also includes a specific study of a CNMP administrative procedure leading to Proposal for Resolution No. 1.00873/2021-72, which seeks to regulate the ANPC. The article aims to provide unprecedented theoretical contributions, particularly regarding the normative proposal under consideration by the CNMP. The conclusion suggests that the tension between consensual methods and justified prohibition in the public interest can be resolved by a comprehensive approach that considers the unique characteristics of the electoral context, without imposing an absolute prohibition on consensual legal technologies in this specialized legal area.
