A Política e a Suprema Corte dos Estados Unidos
Resumo
A Suprema Corte dos Estados Unidos é analisada na busca de influências políticas. São apontados os influxos dela sobre sociedade americana por meio de suas atuações e magistrados. Desde o seu surgimento em 1789, as decisões da corte marcaram decisivamente a divisão de poderes, os direitos civis e diversos outros temas fundamentais da federação americana. O papel de interpretadora da Constituição colocou a corte em um patamar de grande importância na resolução de controvérsias. E, exercendo esse papel, a corte esteve em constante contato com ideologias e interesses políticos que a influenciaram. Essas influencias se tornam mais visíveis durante os períodos de nomeações e aposentadorias, mas ainda são detectadas por pesquisas que analisam os justices por seus perfis na imprensa, casos julgados ou relações entre casos e posições de presidentes e de senados que escolheram os integrantes na corte. Os dados apontam para uma corte que atua politicamente e é fortemente influenciada por agentes políticos dos outros poderes, como impõe o sistema institucional dos Estados Unidos, e que tem avançado na direção de permitir que a sociedade seja relevante no seu funcionamento, garantindo que cidadãos participem na composição da corte e suas decisões.
