Aproximações do Paradigma Libertário do “Right to Privacy” Norte-Americano
Resumo
O problema abordado é a construção do right to privacy nos Estados Unidos da América como corolário da liberdade dos indivíduos. O objetivo é examinar de que modo surgiu esse direito, como se deu a sua compreensão nos tribunais americanos e a visão constitucional desse direito na common law daquele país. Procede-se uma pesquisa teórica, de caráter qualitativo, com pesquisa documental, bibliográfica e jurisprudencial. Emprega-se o método dedutivo. O referencial teórico está subsidiado no right to privacy de James Q. Whitman.
