Abstract

This research analyzes how environmental information is essential to corruption defense and money laundering in Brazil. The study is conducted based on the constitutional principle of information access, in general, to enter into environmental issues. The research uses on the main public policy for preventing fraud and corruption, adopted by the National Strategy for Combating Corruption and Money Laundering, through one of its actions, namely: the National Program for Preventing Corruption. From the perspective of transparency and proactive disclosure of information, management, ethics and integrity, the state's responsibility to self-evaluate itself in order to adapt to the good practices provided by public policy, through self-instructional training, guidance manuals and information sharing, is highlighted. The participation of the Judiciary in supporting the implementation of the Access to Information Law is also analyzed, as well as the case law on the use of information from environmental agencies as procedural evidence. The deductive method was used, based on the concept of the right to environmental information, the importance of public policy to prevent corruption in the implementation of participatory democracy, and the impact of actions under the national strategy to combat corruption on the effectiveness of access to environmental information, with a qualitative research approach. It’s concluded that the National Strategy has prioritized actions to combat environmental crimes, so that, in the future, they can generate positive results and improve Brazil's image in international transparency.
