Nomos, Legal Interpretation and Violence: Robert Cover on The Map of Legal Globalization

Abstract

This article aims to reconsider Robert Cover's thought over the discussions about global law. At first, describes the key features of the transnational legal orders which take place at globalization. Then searches to place Cover at global law by his ideas of nomos and the creation of legal meaning (jurisgenesis). Lastly, suggests that Cover's original insights about the relationship between violence and legal interpretation may help to understand questions about regulation and social control of legal regimes at transnational level.
