Abstract

This paper aims to analyze the crime of illegal practice of medicine based on the provisions of the Medical Act – LAM (Lei 12.842/2013), from the perspective of regulation. This law defines the extent and limits of the medical professional’s performance, therefore the restrictive interpretation of the norm on the legitimacy of the medical practice may bring not only administrative and civil consequences, but also criminal implications, e. g., the crime of illegal exercise of medicine (Article 282 of the Brazilian Penal Code), if someone who is not doctor practices a medical activity. Recent decisions by the Judiciary have reinforced the protection of medical activity, banning professionals who historically endured activities that became illegal after the LAM was enacted. Such restrictions can directly affect regulatory aspects such as freedom of profession, entry restrictions and, public health and acquired rights, all of them constitutionally protected principles.
