A female Supreme Court of Justice. Jurisprudential analysis with a gender perspective.

Abstract

Since 2022, the Supreme Court of Justice, the highest body of the Uruguayan Judiciary, is composed for the first time of three women out of a total of five members. A fact that should not be news, but still is today, since, for example, we have not yet had a Court with total female integration.


We believe that currently it is not possible to conceive the Social Rule of Law without the inclusion of instruments aimed at ensuring formal and material equality, without any type of discrimination, which implies studying it from a new perspective: with a gender perspective.


The opportunity then presents itself to analyze the jurisprudence of this corporation, from this perspective.


The general objective of the research is to contribute to knowledge about the behavior of the Supreme Court of Justice since its majority integration by women.


Does this integration provide a special perspective on this topic? Do these women introduce this perspective when passing sentence? Do the rulings that include the gender issue do so with a substantial reference? Do these judges rule together in rulings in which the gender issue is relevant? Is the minister drafting the sentences with this perspective a woman?


The analysis is carried out on unconstitutionality processes, in final sentences and these are some of the questions that we will try to answer with this investigation.
