Abstract

The US PTO issued, on August 30th, 2016, Patent n. 9.430.468 for a Dutch corporation over a double blind electronic peer review system for academic journals. This patent raises great reaction among academics because such a patent ultimately means protecting an abstract idea that has been largely used by other software, including on line free software. This article analyzes the double blind peer review patent under a comparative perspective with US law, under the Nietzschean theory of justice as an exchange between the two parties. This article demonstrates that it is not the case of a patentable subject matter.
