STUDIES ON BLACKNESS AND RACISM IN THE GRADUATE LAW COURSE AT FDUSP

Abstract
The aim of this research is to identify the presence/absence of themes relating to blackness and racism in the Pedagogical Project of the Undergraduate Law Course at FDUSP. To do this, we use the theoretical assumptions of Africanist theories (Africanism, Pan-Africanism, blackness and Afrocentricity) and Critical Racial Theory; and the methodological assumptions of mixed qualitative and quantitative research (Creswell, 2021), bibliographical research (Gil, 2022; Lima and Mioto, 2007) and documentary research (Cellard, 2008). The research hypotheses are based on the dual realisation that there is an invisibility of issues relating to the black population in undergraduate law courses in Brazil. By adopting the categories of blackness and racism, we are interested in identifying how these themes are present and/or absent in legal education. The research data reveals that education in ethno-racial relations from the perspective of anti-racist education and valuing the contribution of different racial groups in the construction of society is still incipient in undergraduate law courses, which do not incorporate Africanist contributions and the contributions of black Brazilian researchers and intellectuals to theories of law and studies of legal education and research on this subject. Law faculties and other legal education institutions need to reformulate their pedagogical projects with a view to adapting their curricula to legal norms and modern theories of law, boosted by the recent contributions of black jurists and Africanist, anti-racist and black theories.
