Abstract

Data from the National Council of Justice demonstrate that, even with the legal guarantee of reserving a percentage of vacancies in public positions and jobs for people with disabilities, the number of civil servants with some type of disability in the Judiciary is insignificant. Thus, this study aims to analyze the inclusion of people with disabilities within the scope of the judiciary. Using the deductive, descriptive and explanatory method, a bibliographical research was carried out and quantitative analysis of the data contained in the report Diagnosis of People with Disabilities in the Judiciary Branch published by the National Council of Justice in 2022. Based on the analysis of data on the person's participation with disabilities in the functional staff of the Judiciary, and the doctrinal review of barriers faced in the daily lives of people with disabilities, it was possible to conclude that the mere legal reservation of places in public competitions has not been sufficient for the inclusion of people with disabilities in the Judiciary, The lack of accessibility in the work environment is one of the major obstacles to be overcome. As a theoretical contribution, there is the analysis of the legislation on the right to work of people with disabilities and the legal reservation of places in public competitions. And, as a practical contribution, it will support decision-making by public and private managers in promoting accessibility in the work environment.
