THE CONFLICT AMONG PRINCIPLES IN FRIEDRICH MÜLLER’S STRUCTURAL THEORY

Abstract


The paper presented here aims to address, from Friedrich Muller’s theoretical construct, the treatment mode of the conflict among the principles of the Law Structuring Theory. The regulatory framework, from the methodical structuring, constitutes in rule element, signaling that the Law does not end in a logical set of propositions, constituting itself, before, in a regulatory system which tries to run the society and, in parallel, is influenced by it. The study attempts to demonstrate that the solution outlined by the Law Structuring Theory best fits the problem of the conflict among principles, since it considers the legal system as a product of people concrete action, consolidating itself in an eminently practical interpretive proposal.
