BETWEEN OPPORTUNITIES AND NEEDS: THE CONSTRUCTION OF A CONSTITUTIONAL STATE SOCIAL AND ENVIRONMENTAL COSMOPOLITAN

Abstract


This paper aims to discuss about the environmental issue from the modern state formation, its shortcomings and the possibility-need, based on a global law, building a Constitutional State Socio-Environmental Cosmopolitan. In addition to this, namely, to build this other / new state, the environmental issue, raised to the civilizational ideas, will be presented as a condition of possibility for this political-legal project and global society, so that, as a result of this new configuration-design, cosmopolitan par excellence, is promoted an overflow limits that characterize modern statehood.
